India's central bank, the Reserve Bank of India (RBI), imposed a monetary penalty of ₹2.70 lakh on KLM Axiva Finvest Limited. The order, dated September 22, 2026, found the non-banking financial company (NBFC) non-compliant with specific auction procedures.
This action follows the company's failure to return surplus funds to certain borrowers after auctioning their pledged gold articles, over and above the loan outstanding.
Auction Procedure Non-Compliance
The RBI's statutory inspection reviewed KLM Axiva Finvest's financial position as of March 31, 2025. Supervisory findings revealed that the company had not adhered to the central bank's directives regarding auction processes.
Specifically, the NBFC did not disburse the excess amount realised from the sale of pledged gold articles, beyond the outstanding loan, back to the respective borrowers, as required by the 'Auction' procedure guidelines.
Central Bank's Supervisory Action
Following the identification of these compliance deficiencies, the RBI initiated formal proceedings. It issued a show-cause notice to KLM Axiva Finvest, seeking an explanation for its non-compliance. After reviewing the company's written response, additional submissions, and oral arguments presented during a personal hearing, the RBI confirmed the charge, leading to the penalty.
NBFCs Face Stricter Oversight
This penalty demonstrates the RBI's commitment to enforcing regulatory adherence among financial institutions, particularly regarding consumer protection in secured lending.
Non-banking financial companies in India, especially those engaged in gold loan operations, should review their auction and surplus fund disbursement policies to ensure full compliance with RBI directives by the end of the current fiscal year.
