Eligibility for Tax Deductions
Indian homebuyers cannot automatically claim all available tax benefits on home loans for under-construction properties from their initial EMI payments. Eligibility for these deductions is not immediate and hinges on several factors, including the property's completion status, whether the payment is for principal or interest, and the taxpayer's chosen tax regime.
Nishant Shanker, from Navraj Global Advisors' Tax Controversy & Dispute Resolution practice, noted that commencing EMIs before taking possession of a home requires a careful assessment of conditions under the Income-tax Act, 2025.
Principal Repayment Rules
The principal component of home loan repayments for under-construction properties is not immediately deductible. Shanker clarified that merely starting EMI payments does not automatically qualify the entire principal paid during the construction period for deduction.
Instead, eligibility for principal repayment deductions requires examining conditions related to the property's acquisition or completion. These deductions fall within an overall limit of Rs. 1.5 lakh, as specified under Section 123 read with Schedule XV of the Income-tax Act.
Interest Payment Treatment
The tax treatment for home loan interest differs from principal. Interest accrued during the pre-construction period is generally categorised as pre-construction interest. This can typically be claimed in five equal annual instalments, starting from the financial year in which the property is either acquired or its construction is completed.
Interest payable after the property's acquisition or completion date is handled under the standard house property provisions. The final amount of interest deduction can also vary based on whether the property is self-occupied or let out.
Impact of Tax Regime Choice
The choice of tax regime significantly impacts available deductions for home loans. Taxpayers opting for the new tax regime under the Income-tax Act, 2025, generally find that several deductions available under the old regime are not applicable. This includes benefits for housing loan principal repayment under Section 123 and interest deductions for self-occupied properties.
To ensure accurate filings, individuals must separately track principal, pre-construction interest, and post-completion interest, then confirm their eligibility for each assessment year. Consulting a qualified tax planner before filing claims for the 2026–27 assessment year can prevent errors.
